Supreme Courts Delivers Ruling in the Lord Mayor's Case.

In a joint ruling delivered by the Deputy Registrar, His\r\nWorship Thaddeus Opesen on behalf of the five Hon. Justices of the Supreme\r\nCourt ruled that they did not have jurisdiction to hear an appeal arising from a\r\ndecision of one Hon. Justice of the Court of Appeal. They advised the Lord Mayor to take back his appeal to the Court of Appeal to be heard by three Hon.\r\nJustices.

Decision and Orders:-

\r\n\r\n

Supreme Court\r\nheld that the application for\r\nstay of execution was incompetent, and was accordingly struck out. The Court therefore\r\ndid not find it necessary to deal with the merits of the application.

\r\n\r\n

The following orders are the orders made by the\r\nSupreme Court:-

\r\n\r\n

1)    The Supreme Court ordered that the matter be\r\nreferred back to a bench of three Hon. Justices of the Court of Appeal to\r\nexpeditiously hear and determine the application for stay of execution, as a reference\r\nfrom the decision of Hon. Justice Kavuma, Ag. DCJ, sitting as a single Justice\r\nof Appeal.

\r\n\r\n

2)    The Supreme Court ordered that the status quo be\r\nmaintained until the application is disposed of.

\r\n\r\n

3)    The Supreme Court made no order as to costs in the\r\nsaid Court instead ordering that the costs of the application in the Court of\r\nAppeal abide the outcome of the reference.
